These Terms of Service (“Terms”) govern your access to and use of aiagentcommons.com (the “Site”), operated by AI Agent Commons, LLC (“AI Agent Commons,” "AIC," “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1) Scope
These Terms apply to the Site and any demo/inquiry requests you submit through it. Any AI Agent Commons software or professional services are governed by separate written agreements and applicable product/data policies, not these Terms.

2) Eligibility
You must be at least 18 and able to enter into a binding contract to use the Site.

3) Privacy
Your use of the Site is subject to our Privacy Policy, which explains how we collect and use information (including name and email submitted for business development and communications).

4) Permitted use
You will use the Site only for lawful purposes and will not:

• attempt to access systems or data you are not authorized to access;

• interfere with or disrupt the Site (including introducing malware, scraping in a way that degrades performance, or probing vulnerabilities); or

• use the Site to send unlawful, infringing, or harmful content.

5) Submissions and “no sensitive info”
If you submit information through the Site, you represent you have the right to provide it and that it is accurate to the best of your knowledge.

Do not submit sensitive personal information through the Site (for example: government ID numbers, financial account details, or health information). If you do, you do so at your own discretion and risk.

6) Communications
By providing your contact information, you agree we may contact you to:

• respond to your request; and

• send business development and product/service communications about AI Agent Commons.

You can opt out of marketing emails at any time via an unsubscribe link (if provided) or by emailing privacy@aiagentcommons.com. Even if you opt out, we may still contact you about your inquiry.

7) Intellectual property
The Site and its content (including text, graphics, logos, and design) are owned by AI Agent Commons or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Site content without our prior written permission. “AI Agent Commons” and related marks are our trademarks/service marks.

8) Third-party links
The Site may contain links to third-party sites. We do not control and are not responsible for third-party content, policies, or practices.

9) Legal terms (disclaimers, liability, indemnity)

Disclaimers. THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. The Site may describe products/features, but such descriptions are informational and not a guarantee.

Limitation of liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI AGENT COMMONS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SITE WILL NOT EXCEED $100.

Indemnity. You agree to indemnify and hold harmless AI Agent Commons and its affiliates, officers, employees, and agents from claims and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or your violation of law or third-party rights.

10) Changes
We may update the Site or these Terms from time to time. The “Effective Date” reflects the latest version. Continued use of the Site means you accept the updated Terms.

11) Governing law and venue
These Terms are governed by the laws of the State of Missouri, excluding conflict-of-law rules. Any dispute arising out of or related to the Site or these Terms will be brought exclusively in the state or federal courts located in Missouri, and you consent to jurisdiction and venue there.
